Low Cost Divorces

Thanks to changes in the law in 2006, the divorce process no longer needs to involve the cost and hassle of a contested and bitter divorce action. If you are eligible, you can obtain a divorce without having to set foot in court and by making just one or two short visits to our office.  The divorce could be granted within 2-3 months of the application, provided it is not opposed by your spouse.

In those situations, we can offer you a low cost, fixed price divorce application service.

Are You Eligible for a Low Cost Divorce?

We have two different packages – one at £200 (plus VAT and court outlays) and the other at £700 (plus VAT and court outlays). If you do not have children of the marriage under 16, the £200 package could be right for you. If you do have children of the marriage under 16, the £700 package may be suitable. See below to work out which package may suit your circumstances.

PACKAGE ONE – When There Are No Children Of The Marriage Under 16

Cost - £200 plus VAT and court outlays – estimated total £351

You need to meet six tests –

  1. You and your spouse have not lived together as a couple (so you could be living under the same roof but not be a couple) for over 2 years AND if you did attempt to get back together during that period, it didn’t last more than 3 months; OR you have not lived together for over 1 year but less than 2 years and you believe your husband/wife will consent to a divorce; and
  2. You have no children of the marriage under the age of 16; and
  3. You do not believe or expect that either you or your husband/wife will make any financial claims as part of the divorce
  4. You OR your husband/wife live in Scotland; OR if you don’t know where your husband/wife now lives, you do have contact details for their next-of-kin and/or adult children
  5. Your husband/wife does not have a medically diagnosed mental disorder (mild stress or depression does not count).
  6. You consider that your marriage is over and there is no prospect of getting back together with your husband/wife.

PACKAGE TWO – When You Have Children Of The Marriage Under 16

£700 plus VAT and court outlays – estimated total £1,052

You need to meet five tests –

  1. You and your spouse have not lived together as a couple (so you could be living under the same roof but not be a couple) for over 2 years AND if you did attempt to get back together during that period, it didn’t last more than 3 months; OR you have not lived together for over 1 year but less than 2 years and you believe your husband/wife will consent to a divorce; and
  2. You have children of the marriage under the age of 16; and
  1. You do not believe or expect that either you or your husband/wife will make any financial claims as part of the divorce

4   You OR your husband/wife live in Scotland; and

5   You consider that your marriage is over and there is no prospect of getting back together with your husband/wife.
