A Simple Guide to the Scottish Civil Justice System

If you're involved in a legal dispute in Scotland, understanding the civil justice system is crucial to achieving the best possible outcome. Civil cases can arise in a variety of contexts, such as contract disputes, personal injury claims, or property disputes.

At DJP Solicitors, we're here to guide you through the process and provide expert legal advice at every stage. Read on for our simple introduction to the Scottish civil justice system.

Bringing a Civil Case in Scotland

To initiate a civil case in Scotland, you need to submit a written claim, known as a writ, to the court. This document must contain specific details about the dispute and the parties involved. Once the writ is submitted, the court will serve it on the other party, who then has the opportunity to respond. The court will then schedule a hearing, during which both parties will have the chance to present their case.

The Scottish Civil Court System

The Scottish civil court system is divided into two main tiers: the Sheriff Court and the Court of Session. The Sheriff Court has jurisdiction over civil cases involving claims of up to £100,000, while the Court of Session handles civil cases involving claims of more than £100,000. The Court of Session is also the court of appeal for cases heard in the Sheriff Court.

Appealing a Civil Case

If you're unhappy with the outcome of a civil case, you have the right to appeal the decision to a higher court. If the case was heard in the Sheriff Court, the appeal would be to the Sheriff Appeal Court. If the case was heard in the Court of Session, the appeal would be to the Inner House of the Court of Session. Appeals are not automatic, and you must seek permission from the court to appeal.
