The Key Steps To Take Following An Unfair Dismissal

Your appeal could result in a reinstatement at your workplace, a good reference to support future applications, or even monetary compensation. Appeal To Your Employer

The first thing you should do if you feel you have been unfairly dismissed is to speak directly to your employer about the situation, where there may be room for allowances to be made. You can do this with support from a trade union representative if you prefer. It is also recommended that you investigate whether your company has an official appeal process in place, where you should begin these enquiries as soon as possible after your dismissal.


Early Conciliation

If these steps do not resolve your dispute, then you will then need to contact the ACAS, the Advisory, Conciliation & Arbitration Service, where this is an independent public organisation that can start a free process known as early conciliation. This is where you will attempt to solve your dispute with the help of ACAS, rather than going to an employment tribunal.


Employment Tribunal

If all else fails, you may wish to escalate your dispute further. Once you have obtained an early conciliation certificate from ACAS, you will be able to take your dispute to an employment tribunal, where you will have to present evidence to support your case. If you win, you may be entitled to compensation.


Obtaining Legal Advice

Although it is not strictly necessary to have a lawyer present for an employment tribunal, it may be helpful to have an expert in your corner.
